Terms of Service

These Terms of Service (“Terms”) are between you and Chosen Ecom Limited (“Aestify”, “we”, “us”), a company registered in Hong Kong, trading as Aestify. By accessing or using the Aestify platform at aestify.io, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Acceptance

These Terms constitute a legally binding agreement between you and Chosen Ecom Limited. You must be at least 18 years old and capable of forming a binding contract to use this service.

2. Service Description

Aestify is an AI-powered product photography platform that allows Shopify merchants to generate professional product imagery. Users upload a product photo, select a model character, background, and pose from our curated library, and receive an AI-generated product photograph. Each generation consumes one credit.

3. Credit System

• Credits are purchased as part of a subscription plan and grant access to generation features.
• Credits are non-transferable and may not be sold, gifted, or shared.
• Unused credits expire upon account deletion; they do not carry over between billing cycles unless otherwise stated.
• Add-on credit packs purchased separately never expire and carry forward indefinitely.
• We reserve the right to modify credit pricing with 30 days’ notice.

4. Acceptable Use

You agree not to use Aestify in any manner that violates applicable laws or our Acceptable Use Policy. Prohibited uses include generating illegal, harmful, or deceptive content. You may not upload images of real people without their consent. You may not use generated images for deceptive, misleading, or harmful purposes.

5. Intellectual Property

Your content: You retain all rights to the product images you upload. You grant Aestify a limited licence to process those images solely to deliver the service.

Generated outputs: Subject to these Terms and your compliance with our Acceptable Use Policy, you own the AI-generated images produced from your account and may use them commercially.

Platform: Aestify, its AI models, character and background assets, and all platform technology remain the exclusive property of Chosen Ecom Limited. No rights are granted beyond those expressly stated herein.

6. No Warranty

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted or error-free, or that outputs will meet any specific quality standard.

7. Limitation of Liability

To the fullest extent permitted by law, Chosen Ecom Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service. Our total liability to you shall not exceed the amounts paid by you to Aestify in the 90 days preceding the claim.

8. Termination & Cancellation

We may suspend or terminate your account at any time for material breach of these Terms, without notice.

You may cancel your subscription at any time through your account dashboard under Settings → Subscription, or by contacting support@aestify.io. Cancellation takes effect at the end of the current billing period. Credits purchased as one-time bundles are non-refundable but remain valid indefinitely and are not affected by subscription cancellation.

9. Character Library & AI-Generated Content

Aestify operates a pre-curated library of digital characters used in the generation of product photography. All characters in this library are original digital creations owned by or licensed to Chosen Ecom Limited. No character in our library is based on the likeness of any real, identifiable person without that person’s explicit written consent.

Users may not upload, submit, or request the use of any real person’s face, likeness, or biometric data as input for character generation. The platform is built exclusively for product photography — users upload images of the products they sell, not images of people.

Aestify does not produce deepfakes, face swaps, or any content that replicates or impersonates real individuals. Any attempt to use the platform for such purposes is a violation of these Terms and will result in immediate account termination.

All output images are AI-generated and must be used in accordance with applicable laws.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
